Distance Sales Agreement

1. PARTIES

This Agreement has been signed between the parties below, within the framework of the terms and conditions stated below.

By accepting this agreement, the BUYER acknowledges, declares, and undertakes that if they approve the order subject to the contract, they will be obliged to pay the cost of the order and any additional fees stated, such as shipping costs and taxes, and that they have been informed of this in advance.

2. DEFINITIONS

In the application and interpretation of this contract, the terms written below shall refer to the written explanations opposite them.

SELLER: The company that offers goods to the consumer within its commercial or professional activities, or acts on behalf or account of the company that offers goods.
SERVICE: Any consumer transaction other than the provision of goods, performed or promised to be performed for a fee or benefit.
BUYER: The real or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes.
SITE: The internet site belonging to the SELLER.
PARTIES: The SELLER and the BUYER.
AGREEMENT: This agreement concluded between the SELLER and the BUYER.
GOODS: Movable property subject to purchase and sale, and intangible goods such as software, sound, images prepared for use in electronic environments.
MINISTER: The Minister of Customs and Trade.
MINISTRY: The Ministry of Customs and Trade.
LAW: Law No. 6502 on Consumer Protection.
REGULATION: The Regulation on Distance Contracts.

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, concerning the sale and delivery of the product, whose qualities and sales price are specified below, and which the BUYER has ordered electronically via the SELLER's website.

The prices listed and advertised on the site are sales prices. Advertised prices and promises are valid until updated and changed. Prices advertised for a limited period are valid until the end of the specified period.

7. PRODUCT/PRODUCTS SUBJECT TO THE AGREEMENT INFORMATION

7.1. The basic characteristics of the good/product/products/service (type, quantity, brand/model, color, number) are published on the SELLER's website. If the seller has organized a campaign, you can review the basic features of the relevant product during the campaign period. It is valid until the campaign date.

7.2. Prices

The prices listed and advertised on the site are sales prices. Advertised prices and promises are valid until updated and changed. Prices advertised for a limited period are valid until the end of the specified period.

9. GENERAL PROVISIONS

9.1. Information and Acceptance

The BUYER accepts, declares, and undertakes that they have read and are informed about the basic characteristics, sales price, payment method, and delivery information of the product subject to the contract on the SELLER's website, and that they have provided the necessary confirmation electronically.

9.2. Delivery Time

Under normal circumstances, each product subject to the contract is shipped within 3-7 business days.

Delivery time may be extended due to busy periods, campaigns, public holidays, or logistical delays.

The product is sent to the address provided by the Buyer during the order via the Seller's contracted shipping company. The Seller is not responsible for any disruptions experienced by the shipping company during delivery.

10. EXCHANGE AND RIGHT OF WITHDRAWAL

10.1. All products sold on our online site are produced upon order, and returns are not accepted for either domestic or international purchases. This situation is clearly stated on the detail pages of the products.

6.2. Exchange requests for FENİCE GRANDE branded products belonging to the SELLER will be processed with a written notification within 7 business days from the delivery date, and a size or model change will be made, or a discount code that you can use indefinitely will be defined for you. Exchange requests can be made by sending an e-mail to info@fenicegrande.com. The 7-day period will end at the end of the 7th day following the delivery of the order to the BUYER.

6.3. For your product to be eligible for exchange, it must be unused, with tags, and in its original packaging, as purchased. You will also need the receipt or proof of purchase.

6.4. You can get information and support regarding exchange requests by sending an e-mail to info@zeynepozturk.co.

6.5. The BUYER is obliged to inspect the product upon delivery and to immediately notify the SELLER of any defects found. If there is a clearly visible defect in the delivered products, the Buyer is obliged to notify the Seller within two (2) business days, in accordance with Article 23/c of the Turkish Commercial Code No. 6102. Otherwise, the Buyer shall be deemed to have accepted the delivered product in its defective state, in accordance with Article 223 of the Turkish Code of Obligations No. 6098.

12. AUTHORIZED COURT

In disputes arising from this contract, complaints and objections shall be made to the consumer arbitration board or consumer court at the consumer's place of residence or where the consumer transaction was made.

14. EFFECTIVENESS

The BUYER shall be deemed to have accepted all terms of this agreement when they complete the payment for the order placed through the Site.
